Terms of service

these terms govern your use of wagl.com and any purchase you make from wagl. by using the site or placing an order, you agree to them. please read them, especially the sections on disputes and limitation of liability.
"wagl", "we" and "us" mean wagl llc, a virginia limited liability company (hello@wagl.com).
1. what wagl is
wagl is an edited store for well-made objects for dogs. the site works in two ways:
- recommendations (affiliate links). some products link to other retailers. if you buy through those links, you are buying from that retailer, under its terms, prices and return policy, not from wagl. we may earn a commission. see our affiliate disclosure.
- orders placed with wagl. some products can be bought directly on wagl.com. for these, wagl is the seller. each item is either shipped from stock or made to order, and is shipped to you directly by its maker (or the maker's fulfillment partner). see shipping & returns.
each product page tells you which applies: a button that leaves wagl ("shop at" followed by the retailer's name) is a recommendation; "add to bag" is an order with wagl.
wagl is independent. unless a page says otherwise, wagl is not affiliated with, endorsed by, or sponsored by the brands, makers or designers whose products appear on the site.
2. eligibility and accounts
you must be at least 18 (or the age of majority where you live) to place an order. if you create an account, keep your login secure; you are responsible for activity under it. tell us promptly if you suspect unauthorized use.
3. where we sell
at launch, orders placed with wagl ship to addresses in the united states only. some makers may not ship to every us address (for example alaska, hawaii, apo/fpo/dpo addresses or us territories); where that applies, the product page or checkout will tell you before you pay. visitors in the uk, eu, uae and elsewhere are welcome to browse; we will update these terms before we accept orders for delivery outside the us.
4. products, descriptions and prices
we try to describe and photograph products accurately. colors, materials and finishes (wood, leather, ceramic, hand-finished pieces) vary naturally and may differ slightly from screen to screen.
prices are in us dollars and do not include shipping or sales tax unless stated. prices and availability can change without notice. if a product is listed at an incorrect price or with incorrect information because of an error, we may cancel the order and refund you, even after confirmation; we will tell you first.
for affiliate links, the retailer's price at checkout controls. prices shown on wagl may be out of date.
pet safety. wagl products are objects for living with animals, not veterinary products. supervise your dog with any new bowl, bed, toy or accessory, follow the maker's care and size guidance, and remove any item that is damaged. nothing on wagl.com is veterinary advice.
5. orders and payment
your order is an offer to buy. a contract is formed when we send a shipping confirmation. we may decline or cancel an order (for example, if an item is unavailable, we suspect fraud, or the shipping address is outside our delivery area) and will refund any amount charged.
payment is processed at checkout by shopify and our payment providers. you authorize us to charge your payment method for the order total, including shipping and applicable taxes. wagl collects sales tax where required.
6. shipping, title and risk
orders are shipped by the maker or its fulfillment partner, from the maker's own studio, workshop or warehouse. estimated ship times vary by maker and are shown on each product page; see also shipping & returns. if we cannot ship within the stated time (or within 30 days if no time is stated), we will tell you and give you the option to cancel for a full refund.
title and risk of loss pass to you when the item is delivered to you.
7. returns and refunds
returns are handled as described in shipping & returns. return terms are set by each maker and are shown on the product page before you buy. some items (personalized, made-to-order, final-sale, or hygiene items) may not be returnable; this will be stated on the product page before you buy. nothing in these terms limits any non-waivable right you have under consumer law.
8. reviews and content you submit
if you submit a review, photo or other content, you confirm it is your honest experience, that you own it or have permission to share it, and that it does not include anyone else's personal information without consent. you give wagl a non-exclusive, worldwide, royalty-free license to display, reproduce and adapt it (for example, crop a photo) on wagl.com and in wagl marketing, with credit where practical. we may decline or remove content. we do not edit reviews to change their meaning, and we do not suppress reviews because they are negative.
9. intellectual property
the wagl name, logo, site design, text, and original photography are owned by wagl llc or its licensors. you may browse and share links for personal, non-commercial use. you may not copy, reproduce or reuse site content commercially without permission.
brand names, product names and trademarks of other companies belong to their owners and are used only to identify their products.
if you believe content on wagl infringes your copyright or trademark, email hello@wagl.com with the subject "ip notice", identifying the work, the page url, your contact details, and a statement of good-faith belief.
10. acceptable use
don't misuse the site: no unlawful use, no interfering with security or performance, no automated collection of site content or prices without written permission, no impersonation, and no posting of harmful or misleading content.
11. third-party sites
links to retailers, brands and other sites are provided for convenience. we don't control them and are not responsible for their content, products, prices, privacy practices, or fulfillment of orders placed with them.
12. disclaimers
the site and its content are provided "as is" and "as available". to the extent permitted by law, wagl disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement. products sold by wagl carry the maker's warranty, if any, as stated on the product page; wagl does not add its own warranty unless stated in writing. this section does not limit warranties that cannot be excluded by law.
13. limitation of liability
to the extent permitted by law, wagl will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site or products. our total liability for any claim relating to a product is limited to the amount you paid wagl for that product. some jurisdictions do not allow these limits, so they may not apply to you. nothing here limits liability for death or personal injury caused by negligence, or for fraud.
14. indemnity
you agree to indemnify wagl against claims arising from your breach of these terms or misuse of the site, to the extent permitted by law.
15. disputes and governing law
these terms are governed by the laws of the commonwealth of virginia and applicable us federal law, without regard to conflict-of-law rules.
please talk to us first. most issues can be fixed by email. write to hello@wagl.com with "dispute" in the subject and give us 30 days to resolve it.
if we can't resolve it, any claim must be brought exclusively in the state or federal courts located in fairfax county, virginia, and you and wagl consent to their jurisdiction. either of us may instead bring an individual claim in a small claims court that has jurisdiction.
if you live in the uk or eu, you keep the protection of mandatory consumer laws of your country and may bring proceedings in your local courts.
16. changes
we may update these terms. the version posted when you place an order applies to that order.
17. general
if any part of these terms is unenforceable, the rest remains in effect. our failure to enforce a term is not a waiver. you may not assign these terms; we may assign them to a successor. these terms, together with the policies linked here, are the entire agreement between you and wagl about the site.
